By downloading, installing, or using the Shynel mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.
2. Description of Service
Shynel is an AI-powered jewelry photography application that transforms user-uploaded jewelry photos into professional-quality product images. The App provides various preset styles including studio shots, lifestyle images, model shots, and marketplace-ready visuals for e-commerce platforms.
3. User Accounts
To access certain features of the App, you may need to create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
4. Subscriptions and Payments
4.1 Free Samples
New users receive 2 free AI-generated images to evaluate our service quality before subscribing.
4.2 Premium Subscriptions
Premium features require a paid subscription. Subscriptions are billed in advance on a recurring basis (weekly, monthly, or yearly) through your Apple App Store account.
4.3 Cancellation
You may cancel your subscription at any time through your Apple App Store account settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial subscription periods.
5. User Content and Intellectual Property
5.1 Your Content
You retain all ownership rights to the photos you upload to Shynel. By uploading content, you grant us a limited license to process your photos solely for the purpose of providing our services.
5.2 Generated Images
You own the AI-generated images created from your uploaded photos. You may use these images for personal and commercial purposes, including selling products on e-commerce platforms.
5.3 Our Intellectual Property
The Shynel App, including its design, features, AI models, presets, and technology, are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.
6. Acceptable Use
You agree not to use the App to:
- Upload content that infringes on intellectual property rights of others
- Upload illegal, harmful, threatening, or obscene content
- Attempt to gain unauthorized access to our systems
- Use the App for any fraudulent or deceptive purposes
- Interfere with the proper functioning of the App
- Violate any applicable laws or regulations
7. AI-Generated Content Disclaimer
Our AI technology generates images based on your uploaded photos. While we strive for high quality, AI-generated results may vary. We do not guarantee that generated images will be suitable for all purposes. You are responsible for reviewing generated content before use.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHYNEL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE APP.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Indemnification
You agree to indemnify and hold harmless Shynel and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
11. Termination
We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination shall remain in effect.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
